Mr. Hugh-Jones submitted that the association was not a legal entity and, therefore, could not sue in its name.

Mr. Remedios contended that Ha Kim was also suing, and question- ed the term of legal entity. If, he asked, a firm could sue in its own name, why could not an association? He added that any one could come into Court as a body and seek re- dress.

His Lordship ruled in favour of Mr. Hugh-Jones and Mr. Remedios asked leave to amend the writ. He said that he would strike out the Coal Workers Association and 1 leave in only the name of Ha Kim. as the chairman of the Associa- tion, and other members as plain tiffa

ANOTHER OBJECTION

Mr. Hugh-Jones also objected to that on the grounds that if Ha Kim would sue, then it followed that he could suc for damages suffered by the Association, where- as in the present writ it was a

sult for damages suffered only by Ha Kim.

He submitted that there should be a substitution of another course

of action and that the present proceedings be dismissed.

His Lordship sald that the action was dismissed as regards the firal defendant, and an order for non- suit would be placed against the
