An appeal against made in HM. Supreme Court on August 7, 1935, allowing the pet- tioner in a divorce case to take his child out of the jurisdiction of the court, was heard before the Full Court of Appeal yester- day. Judge A G, Mossop, Judge P. Grant Jones and Judge R. E Lindsell, Pulsne Judge and acting Chief Justice "of Hong Kong, pre- sided at the hearing. Mr. H A Reeks appeared for Mr. G. W. Moss, the petitioner in the divorce case, and Mr. J. McNeill for the respondent, and appellant in these proceedings.

In

Mr. McNeill and that the Jurls- diction of a court in England in s divorce case depended upon the domicile of the petitioner, and proceeded to define the meaning of the word "domicile."...In this case," they must take it that the place where the petitioner, who was DOW on leave in England, intended to reside permanently was still, in China. Question of Access

The Supreme Court could not make an order for access ir both the petitioner and the child were: not within the jurisdiction of the court. The Court was now precludź ed from granting access, although a gulity wife was not now compel- led to be kept away from her child. for ever, Mr. McNeill allowed,' however, that if the petitioner were in Shanghai the court could make an order for access. In re- ply to a question by Judge Mossop to what harm the Assistant Judge's order had brought upon, the appellant, Mr. McNeil said. that they did not know whether the petitioner would ever definitely return to Shanghai. It was wrong for a child of tender years. to be. entirely removed from its mother's custody. He submitted that if the Assistant Judge had intended to insert a provision for access to the child, it should have appeared in the decree. Ha understood that; during the hearing of the divorce case there was considerable dis cussion as to access. The amend- ment asked for now was that the child should be brought back to wishin a Shanghai

reasonable time.

Mr. Reeks. said that the amend- ment asked for was that the child anould be brought back within a period of six months." This might be a physical impossibility, as the petitioner might already have left England without the child. He, submitted that the Assistant Judge had nct erred in law, as had been alleged, and that he had full,pos wer to take the child out of the jurisdiction of the court.
