Defendant went to the other boat to have his meal while witness and Chiu Kwai had theirs in their own boat. Defendant returned to the beat, and ten minutes after he had finished his meal. he was asked to bale the boat. As he was doing this defendant hit him on the head with a chopper.
Witness could not given any reason for the assault upon him but he thought the motive must have been that defendant wanted to get away with the cargo of sugar without the knowledge of the owner.
After further evidence was taken defendant was committed to stand his trial at the next Criminal Sessions.
