LARGE OPIUM HAUL

Leave To Appeal

The larg oplum haul made on the s.s. Pleasantville had a sequel yesterday before Mr. W. M. Thomson at the Kowloon' Magla- tracy when five Chinese Sing Fat, quartermaster, L Yau, car-. penter, Lt Ping, nightwatchman, -and Chau Ngau were convicted of charges of possession of optum on board the boat and with doing an act

exporta- preparatory to tion. The amount of value was stated

be 3,340 to

taels. The fourth and Afth defendants were Hugh- represented by Mr. G. S Jones while Mr. E. W. Hamiton Superintendent of Imports and Exports prosecuted.

11

The case was adjourned from September 12 to consider the de fence's submission that the re- venue cfcers having got the defendants in custody with the Intention of charging them had no right to question them at all,

On resumption of the case yes- terday. Als Worship Informed the defence that he had considered their submission, but was ruling against them.

ACCUSED'S STATEMENTS

Wan Pak Yu. Interpreter of the Import and Export" Office, stated that fourth... and. Alth accused

made a statement in the presence of CPO Buller.. Fourth accused said, "I went on board the City of Pleasantville at 3.30 am, and went to the stern and saw sever-

I

board for half an hour. My object was wo see if any

arrangements, had been made to take the oplum on board,"

Firth accused, stated "I went on board the City of Pleasant- vile-between-9 pm and 10 pm. and saw some men pull up some- thing from the stern. I did not interfere; I went down the gang- way to see what was the mat- ter."

Cross-examined by Mr. Huga- Jones, witness stated that both the defendants made no state- ment until they were questioned,

This concluded the case for the prosecution and Mr., Hugh-Jones. on behalf of fourth accused, sub- mitted that there was no case to answer. The only direct evidence against accused "was that he was seen at the "bottom of the gang- way and he was arrested. It was submitted that his standing the bottom of the gangway was no evidence of possession. Al- though defendant admitted he went on board and saw some- thing being pulled up at the stern, it was, not evidence that ho was in possession,

WBS

At this stage Mr. Hamilton stated that the prosecution prepared to accept this and with- drew charge (a) against defen- dant.

"

· NO EVIDENCE

Replying to the second charge, counsel submitted that there was no evidence of defendant doing an act at all. He was a watch- man employed on the ship. It might be that when he saw the bags being pulled up. he to see what was being done but did not interfere. A mere breaca of duty did not constitute 310 act.

"The experience gained yesterday proved that any competitor who takes part in these weekly practices or competitions must provide him- self with binoculars or a telescope. when it is remembered that the spoting disc at 200 yards is 1 square inch only, it will be realised that the human eye is quite in- capable to discern this at that distance.
