NO CASE TO ANSWER. Addressing the Bench, Mr. Kwan submitted that his client had no case to answer. There was abso- lutely no evidence to support any charge for possession elther in fact or a law.
He then quoted as his authority a case in which a conviction for possession was quashed in an ap- peal against the sentence, when the learned judges ruled that al- though the defendant (in what particular case) admitted calling for a certain item, the possession of which would have constituted a charge of unlawful possession, the mere fact that the police had in- tervened before he actually had possession of it, ruined the whole case against the guilty partly, and on these grounds the conviction was 'qubabed.

After evidence was heard both sides Mr. Justice Lindse gave judgment of $375 to plaintiff with costs while the counter claim vas also dismissed with costs.
