MARINE COURT CASE.

Leaving Port Without Clearance.

A Chinese boatinan named Leung Chui, aged 48 years of Junk "No." T5093H, appeared before Comman- der Hole at the Marine "Court yesterday, charged with leaving

port without a clearance from the Harbour, Master last Monday.

Water Police Sergeant May who prosecuted, told Els Worship that while he was on duty in the Water Police Launch last Monday night, he met with the defendant's boat, which at that time was leaving the port. He stopped the defen- dant and asked if he had got a clearance from the Harbour Master before he was leaving. but the defendant failed to produce it.

The defendant in pleading guilty, sald that he forgot to go to the Harbour Office to get a clearance, as he thought his cousin, had already done so.

The Magistrate, however, impos- ed a fine of $10 on the defendant or one week hard labour in de- fault.

INDIAN FINED $50.

Obtaining Money by False Pretences

"

Accused of obtaining $40 from a Chinese coolic, by false pre tences, Sheik Abdoola, 45, pleaded, not guilty before Mr. Balfour in the Central Police Court yester

day.

After evidence was taken, his Worship convicted the defendant of obtaining $25, and imposed a fine of $50 or one month's hard labour in default: Defendant had a previous conviction for unlawful, pawning.

when Sub-Inspector Fender stated that there was no evidence against him, except that he was arrested in" company with first defendant. and was wearing the trousers.

Sub-Inspector Fender said the first defendant was a friend of the complainant, and on the after noon of January 13 visited him at May Hall, and, while complainant was away, went off with the articles. He was arrested on Man- day afternoon in Queen's Street. Both defendants were going back to Swatow on the ss. Hydrangea.

Li Chung Lin admitted the theft of the trousers and one fountain pen and pencil.

Mr. Hamilton remarked that he would bind him over in $60 to keep the peace for six months, as he was a young man and had not been in trouble before.

As defendant desired-to be sent) back to Swatow, Mr. Hamilton re manded him in police custody until

the boat leaves.

The second defendant also ex- pressed a wish to be sent to Swa- tow, and as he was willing to re- main in police custody, Mr. Hamil- ton agreed, saying the Poor Box would pay ang money necessary for their fare.

Remand

Charges of a serious nature, ac- cording to the Magistrate, were preferred, at the Kowloon magis- tracy yesterday against a Chinese named Chan Kwok Wan who was arraigned on charges of having obtained: 8250 by false pretences from an old man and of "having falsely represented himself as a Western medical practitioner,

According to Detective Sergeant Kennedy who prosecuted the de- fendant represented himself as a medical practitioner, and obtained $250 from Li Ying Chau, Living at for a 69. fore ask for an adjournment in order to enable him to go into the particulars of the ease.

His Worship remarked that he would not grant the remand had the case not been of such a serious nature. The defendant had ample time to arrange his defence but na Mr. Cole had only been in- structed, within such a short time he would remand, the case will next Monday after.

He warried Mr. Cole that he would be severe in dealing with the defendant unless, of course the defence had proved its cake,

He was hot granting the remand mainly on the ground of giving Mr. Cole time to go into the case but on the ground of the impor tance and seriousness of the case. Mr. Cole then asked for bail and his Worship fixed it at $2,000,

2nd floor, early yesterday morning. Sub-Inspector Fender sald defen dant gained access to the floor by climbing over the verandah of No. 238. He was arrested at the foot of the staircase.
