"I am satisfied on the evidence that the plaintiff did in fact give credit to the defendant and that she did so owing to the defendant's conduct at the time of the von tract," said Mr. Justica Lindsell in the Summary Court yesterday when she gave judgment for Mrs. A. B. Oxberry for $314.59 in respect of her claim against Mr: A. Wheeler of Messrs Thos. Cook and Sons. The claim was for board and lodg ing and refreshments supplied to Mrs. Wheeler at the Palace Hotel. Mr. R. H. Cole of Messrs. Geo E. Hall Brutton and Company sp peared for the plaintiff and Mr. F. H. Loseby, of Messrs. Russ and Company, was for the defendant, Evidence was given yesterday by Mr. Albert Bower, manager of the Palace Hotel, to the effect that when Mrs. Wheeler went to the Hotel to book har, room: she was accompanied by her husband.
