The case for the prosecution was that in December, 1930, Barman controlled all the capital of the Chosen Corporation which, at that time, was divided, as to about! three-fifths of which, say £300,000, was in the hands of Harman's group of companies, the remainder being held by the general public. There would be evidence that from January, 1031, to August, 1932, the Chosen Corporation, or the board, consisting of the four defendante, expended £130,669 in the purchase of the Chosen's own shares.

That money, proceeded Mr. Ro- berts, was partly the Chosen Cor- poration's own money, bat was principally the money of one of the Japanese companies, and therefore in his (counsel's) submission, was the Chosen Corporation's money, because everything that the Japanese companies owned was really the property of the corpora tion. With that £130,669 Harman and his co-directors bought for the corporation or for the Japanese companies--which was the same thing-173,029 share in the cor- poration. The price worked out at an average of 15a a share, and there would be evidence. given that at all material times the Stock Ex- change "quotations for these chares was haver bigher than Gs, and one could safely say that all the time they were procurable at 2s. or 38.
