Plaintiff's Witness Closely Questioned

The claim for 890,650 by Messrs, Raven & Basto, architects, against the Wo Lee Land Investment Co. and Messrs. Wo Lai Tin and Chau Yue Ting, partners therein, for the Chater Bungalow site, was con- tinued before Mr. Justice Wood at the Supreme Court yesterday.
Mr. Eldon Potter, K.C. and Mr. H. G. Shaldon (instructed by Mesara Hasting & Company) are for the plaintiffs while Mr. F. C. Jenkin, K.C. and Mr. H. C. Mac namara are for the defendants,
Cheng Chiu Nam, a partner of the firm of Mesurs. Raven and Basta was cross-examined by Mr. Jenkin yesterday.
In reply to counsel Cheng said that the capital of the syndicate was nine lakhs of which only 30 per cent. was put up in the first instance. The site cost $901,000, ten per cent. ) only being paid down at once. The reason why only such a small per- centage was paid at the outset was beenuse the company intended to soll the whole lot as one piece in the near future at a profit. There was not the slightest suggestion that the syndicate build on the land. themselves, at the first meeting following the purchase.
Mr. Jenkin-If it was intended to build, the syndicate would need more capital, wouldn't it !—No. The object of the inanager, Woo. Lai Tin, was to huild a few houses with the balance of $80,000, sell them at profit and use the proceeds to build more houses.
Witness admitted that on August 26, Iny-out plans were in the hands of brokers for the purpose of get- ting purchasers for the sections. The plans had not been approved by the Government at that time.
Questioned about the minutes of the meetings of the syndicate wit ness said that when it became prob- able that they could not sell the land as a whole of by sections, Woo wanted building plans made out as he feared they might lose money. The syndicats had never built on any lot themselves.
Why Did He Sign? Referring to a letter dated Octo- ler 13 which was sent to the Public Works Department for permission to build-78 houses on the site, Mr. Jenkin asked witness whether he agreed that Mr. Wo Lai Tin could not have signed such a letter. Wit ness replied that he did sign.
Mr. Jenkin: By October 13, enle agreements for no less then 4 sections on that c'te had been enter- ed into 1-I don't know how many had been sold. If the aites had been sold, why did he sign it?
Mr. Jenkin: Exactly what I am putting to you. Why did he sign the letter?
