In H.M: Supreme Court in the action of Reuben Joseph Moalem against his mother, Mrs. Sophie Joseph Moslem, concerning the estate of Joseph Joseph Moalem, Judge P. Grant Jones reserved judg- | ment at the conclusion of the argu- ments of Mr. J. E Badeloy, counsel for the defence, and Mr. K. E. Newman, who appeared for the plaintiff.

Mr. Badeley stated that there were three original issues in the case, nanicly, that the will was duly signed according to Will Act, eg signature at end, two witnesses in presence of testator and each other; that testator was of sound mind and understanding and approved of the will; and that the testator was enerced by the defendant Rodda

and others, or namely, undue in- Auence.

Since the first point bad been ad- mitted by Mr. Newman, and the third point withdrawn, Mr. Badeley dwelt his arguments at length on the second point, namely, what was meant by a sound disposing mind and memory.

Answering Mr. Badeley's charga that the plaintiff - hnd knowledge of the will long ahead of the filing of the suit, Mr. Newman said that it was only after the plaintiff had had conversation with Miss Fler- ence Monleni on February 24 that he was enlightened of the exist once of a will. The record of the Registry showed that the plaintiff made an examination of the will and codicil on February 25.

Mr. Newman further drew the at tention of the Court to the evidenos that when the plaintif asked his mother for the doceased'a: papers, she did not mention, the 'will and thereby permitted him to think that: there was no-will-at-all.
