Mr., F. C E. Rendall was for plaintiff and Mr. Horace Lo for the defendant.
The statement of claim was. че the effent tint the plaintiff had 'con- tracted to buy 1,000 bags of No. 24 white Java sugar from the de- fendant for 323,420. The sugar bad not been delivered within the specified time and the plaintiff was obliged to buy it on the open mar ket. This had meant a loss of $1,804 on the deal, plus commission, but the plaintiff waived the amount over $1,000 in ardor to bring the claim within the jurisdiction of the Court.
The defence was that no cantruct was made at all, or, if one had lieen made, it had been altered and was not a true contract between the parties.
After hearing evidence, the ente was adjourned until Tuesday.
