"SUSPECTS' CHARTER.”
A famous criminologist recently designated the Commission's report as "the Suspects'. Chartor." "And such stundoubtedly is. Every niemu- bar of the criminal fraternity knewa that if he is. questioned by the police on any matter, he is fully at liberty to remain silent. No harm will ocme to him through his silence, for he has the Commission behind hian. Suspects may not even be question- Loc..

In this way is the detective of to- day' handicapped. The whole ma chinery of criminal investigation, built up by years of practics and experience, has had to be scrapped, and its place taken by a system re modeled on the Commission's and- ings and Judges' rules, which dis allews all questioning of suspecte, jand prohibits the hitherto, universal gad very successful practice of ali- mination of possible culprits by my wholesale round up and inspection

Fifteen months after the Com, mission's report was published-dur ing which time the damaging effect had already been felt--a confidenti al memorandum was issued by the Home Office giving the views of the King's Bonch judges on the ques tions raised. the amendments they made to the HONG KONG METEOROLOGICAL judge rules (drawn up for the guidance of police in the prepara tion of evidence) was intended to leave the police in exactly the same position as formerly.
E
DETECTIVES' FEARS,
But experience has since shown. that these boisted amendments did not have the desired effect." "The res-" trictions, reprimands, famous court CABOS and remodelled regulations have resulted in detectives deciding to play for safety and not to rua the grave risks by interpreting the findings in a wide dégrée.
Experienced detectives have said that after many years' service they are not going to mar their prospects of advancement or wreck their police enreers by taking liberties with the regulations, even if their onutiousness means the escape of the culprit.
The fact is." wrote an experienc ed detective officer recently, that the rules relating to the questioning of suspecte are a stranglehold--not on the criminal as they should be but on the investigating police
officer. We do not want and never have practised Third Degree. We hate it, and would never use
it if allowed, but we would de our in more thoroughly and properly if the regulations regarding quas tioning of suspects were sensibly re- vised so that the community did not suffer at the expense of sentiment ality over criminals."
