His Lordship said that he had no doubt that the Magistrate acted in good faith in the interests, as he believed, of the prisoner. His Lord ship adhered to the view that it was no part of the duty of a Magis trate to advise a prisoner. The Magistrate had to confine himself to what he is directed to do in the Ordinance, namely, to give the ne cused person the option of making a statement, if he wished to do so, and warn him that anything he might say might be used at his trial.

Counsel asked the jury to accept the medical evidence given, which pointed to the cause of death as strangulation, and the testimony of the witnesses who had stated that they saw the prisoner putting something round deceased's neck,

In his speech for the defence, which occupied nearly two hours, Mr. Jenkin dealt with the evidence of the witnesses and pointed out the inconsistencies in the statements of the women which were unacceptable as evidence.
