MOTHER'S RIGHT TO HER CHILDREN."
A SINGAPORE CASE,
APPLICATION OF ARAB PARENT.
An interesting legal dispute as to the rights of custody of three child- "ren under Mohammedan law was a subject of a long legal argument before Mr. Justice Palgrave Simp- son in the Supreine Court, Singa- pore, last week, which eventually ended in the parties agreeing, on his Lordship's suggestion, to an order by consent.
The plaintiff was the mother of the three children (aged 10 years, 14 years and 12 years, respectively, tire eldest and youngest being girls), and she asked for the custody |of her children ander an originating
summone, the children at presenti being in the caro and custody of their uncle,, Mohamed bin Dawood bin Haji Hassan, and were the issue of Salleh bin Ahmed bin Haji: Hassan, who died about 12 years ago. The mother remarried reccnt-

Mr. R. Williamson, for the plain tiff, claimed that the mother was the legitimate and natural guard ian..
Mr. E.A. Stevens, for the re-i spondent, disputed this, and con- tended that it was in the best in terests of the children to reinain under their present guardianship. 'Ho submitted that if he showed good cause for them remaining with their uncle the court could overrule the fact that the mother was the legitimate guardian. He did not in. tend to strike at the morality or insufficiency of the inother to he guardian.

He submitted that if he could show, without straining the English con- science as between the parents and the children, that according to the tenets
or customs or traditions of those people, it would be against their susceptibilities in the cireum- stances that the mother should re main sole guardian and have the custody of the children, the court
