No Consent to Marriage, Pétitioner's case was that neither she nor the respondent intended to give, nor did give, consent to the marriage. They both ergarded the ceremony as a means of making their engagement or promise of marriage more definite with the view of persuading the petitioner's

parents to agree.

The unfortunate thing for the petitioner, his lordsh said, was that there was no cor oration of her story so far as the essential fact of the absence of intention to enter into marringe was concerned, as the respondent had not been examined

а witness. The difficulty in the case lay in this. that though extraneous evidenco night be necessary to prove a marriage when the ceremony was admitted, the court must be satis fied on the evidence that the parties did not intend what they said they intended if the cérrowany was to be declared to have had no effect. *

The ceremony, which was gone through, was exactly the sume ceremony which his lordship had been asked in. a recent ense hold constituted a marriage, the priest" in the case being the blacksmith at Gretna. The nar ringe was constituted by a mutual agreement between two persons to accept each other as husband and wife..

tr

In the absence of the respondent his lordship was unable to hold that the petitioner had proved that

Mr. Jewby, who had one hand-

heavily bandaged, told reporter of his fight with the men:

"I thought that he was alons. I struck at him and, catching hins on the jaw, knocked him through the glass pane of the shop'door.
