IS EXTRATERRITORIALITY STILL IN FORCE?
A highly important case of juris diction involving the question as to whether Spanish subjects con- tinue to enjoy extraterritorial rights, in spite of a declaration issued by the Chinese Government that the Sino-Spanish Treaty has expired, has been filed in the Shanghai Special District Court by Messa. M. L. Reubin & Co.. Russing contractors, against the Spanish Augustinian Corporation. Plaintiffs claim Tls. 25,800 damages alleged to have been caused through defendant's breach of contract.
Plaintiffs allege that a contract was entered into with defendants for the construction of a godown at 558 Broadway at a cost of Tls. 170,000. Whilst they were still per- forming their part of the contract, plaintiffa claim, defendants notified them that the contract had been cancelled. As a result, they had suffered damage in the suni claim- ed.

Action was filed and defendants were summoned to appear before the Special District Court but they declined to do so one ground that they enjoyed extraterritorial rights, that the Chinese courts had no judisdiction over them, that the Sino-Spanish Treaty is still in force and that they were aubject only to the jurisdiction of the Spanish Consular Court.

CANTON, June 27. The Provincial Government of Kwangtung has again reiterated its order to the Magistrates through- out the province to permit no for- cigners passing through their re spective districts unless bond fide passports are produced.
The Government complains that many foreign travellers fail to observe this rule, and are going from ene place to another in the interior without proper passports. This must be discontinued.
The Government order further ex. plains that as soon as a foreigner leaves a treaty port, he must possess a passport.
The different district authorities have been, instructed to detain such foreign travellers and send them back to the nearest treaty port.
