DEFENCE CONDEMNS CHINESE REVENUE OFFICERS' EVIDENCE: HEUSEN
ון
LAWYER CALLS IT "A GARBLED STORY."
In spite of the fact that Mr. R. E. Lindsell sat up till 7 .p.m. yesterday in an attempt to finish the case in which Mui Kwok Leong, a Singapore J.P. is charged on two counts of possession of opium and one of alleged attempt to expert the drug, another adjournment was found necessary.
The defendant completed his evidence yesterday afternoon. Under cross-examination by Mr. Lloyd, he claimed that he was worth about $30,000, which figure included his tin-mining con- cessions. Mr. Lloyd produced a copy of the Straits Government Gazette and asked if defendant could explain why the letters J.P. did not appear, after his game. Defendant thought that probably the present proceedings was responsible for that.
1
In his defence, Mr. Strellett pointed to the conflict of evidence between the Chinese .. Revenge Officers, describing it as merely concoctions calculated to conceal something. Mr. Strellett also drew attention to what he described as the"" Kotewall motif” among the Chinese Revenue Officers, drawing attention to the fact that they appeared very anxious to draw in Mr. Kotewall's name in order to show the defendant in as bad a light as possible.
DEFENDANT TELLS WHAT HAPPENED ON MARCH 11.
Giving evidence, defendant-stated that he and the coolies carrying the luggage proceeded to the Po Tak Wharf. He had used that wharf when his wife went to Singapore on January 18. On arriving at the wharf, a motor boat was engaged by the fobia of the Empress Hotel. The luggage was put down on the sen-wall. The slings were taken off and two of witness pieces were already or the motor boat when C.R.O. 35, in uniform, came up and said to him, Whose luggage is this" He said, "This is mine!"
Open it for search," ordered the C.R.O, and withess re- plied. Can it be exempted from scarch, I am a J.P. of Singapore."
In order to prove that he was one, witness took out several cards and picked out the card of the Hon. Mr. Kotewall and pointed out to the offer that he (witness) was described as a J.P. in Singapore. After looking at it, the C.R.O. re- turned the card to witness and And nid, I can't read English,' asked for the luggage to be opened for inspection. Witness then said, These Infge leather suitcases are not mine. They belong to my friend, Lam, who told me to carry them. They were brought to me this morning." C.R.O. 35 and other people were present and several other Chinese had gathered round. They tested the weight of the bigger bags by lifting them and pointed out that they were very heavy. Witness also went up and lifted up one of the big bags and was amazed to find that it was so heavy, He offered his keys to C.R.O. 35, having taken them out of the right hand pocket of his coat where he usually kept his keys.
Wanted the Big Ones. C.R.O. 33 then said, "I don't want to inspect the small ones, I want to see the big ones." Witness felt his pockets but did not feel the keys which had been handed to him that morning. He then said, "I have keys, but I don't know if I left them in the Hotel. Let me go back to look for them." He then went back to the Hotel. As far

Air. Strellett: On what date was that, please?
Mr. Lloyd: March 91. Mr. Lindsell (to defendant): Da you know if that is so 1—No.
Mr. Streliett: He is not allowed to read even a newspaper at pre-
his room and the C.R.O. stood out- side while he made a further search. Shortly after the room boy came in to help him look for the keys.. He then tried to find Lam Tin Yau's name in the telephone directory as he remembered Lam had said he would be staying on the Peaksent. Road. Witness said that there were Mr. Lindsell: Have you reason. a lot of Lams but not the name to believe that this firm have ap- of Lam Tin Your in the directory. |plied to make you bankrupt !I He did not use the telephone, at have no reason to believe that. all. At no time did C.R.O, 23 enter the room. When witness walked out of his room C.RO. 23 was walking towards him. Witness did not any to the Revenire Officer such words as He is still in bed." Defendant went to the lavatory and the officer stood near by. Witness then went downstairs and met European, Revenue Officer and C.R.O. 35. They all returned to the wharf, where he noticed R.O. Ward had arrived.
"That's Oplum."
In answer to R.0. Ward's in quiry, witness replied that the luggage, was his, and pointed to the big cases and said that those were not his property. R.O. Ward asked for the keys and he told him that he had been to the Hotel twice
but could not find the kers. R.O. Ward the "whipped out" bis screw, driver and broke open the back of one of the big bags. Wit aess was standing not far from him. He saw some white cloth in the bag and asked What's that?'' and 1.0. Ward replied, "That's opium. He then said, "If I knew that it was ophim, I would not have accepted the luggage,

Mr. Lindsell (to Mr. Lloyd): You are also entitled to ask him whether, since his arrest, he has seen anything in the newspapers to that effect.
Mr. Lloyd: I would have thought the notice which was addressed to him would have been brought to his notice,
Witness (to the Court): I have seen nothing of the sort. I' am surprised to hear that. I retired from that firm in 1923 and the deed of sale was legally made.
Mr. Lloyd next asked whether it was a fact that witness was no longer employed by Nanyang Bros. He replied that he had no intima- tion to that effect. Mr. Lloyd then stated that he had been informed that a letter had been written to defendant dated February 25 ter- minating defendant's services us from March 1.
Mr. Lindsell: If, in fact, there is such a letter in existence, surely it can be produced, Mr. Lloyd1.
Mr. Strellett explained that he had made inquiries, "and 'had been informed that as a measure of economy Nanyang's were doing away with their advisers and alt the branches have been advised to that effect. There was no intention of aiming at the defendant. Both aides then agreed to leave the all went to the Imports and Ex-matter at that. The defendant, in ports Office. Mr. Lloyd next questioned defen- daat as to whether he was a member of the Committee of the Singapore Po Leung Kuk. Defendant said that he was a member when he left Singapore in December." Mr. Lloyd produced a copy of the Straits Government Gazette, in which it was stated that someone else had been nominated to fill be defend. ant's place, as the latter had "re- signed."
