HONG KONG, SEPTEMBER 11, 1929.

THE INSURANCE OF TELEPHONES.

In 1025 the interests and obliga. tions of the China and Japan. Telephone and Electric Co., Ltd., wors taken over by the Hong Kong Telephone Company. Prior to this transfer, some-if not all-contracte with telephone subscribers appear to have included & clause expressly stipulating that the latter were responsible for instruments and Attings installed on their premises, except in regard to such damage as resulted from fair wear and tear.,, Obviously, damage or destruction a a result of fire was excluded, and subscribers were held responsible for any loss to accruing. When the interests at the Chian and Japan Telephone Company were transfer. red to the Hong Kong Telephone Company, the Telephone Ordinance (1928) appears to have limited the liability of the new concern to the extent of not requiring it to make good damage to telephone apparatus not caused by fair wear and tear. If this be the fact, then it would seers perfectly clear that the Telephone Company-insolar as subscribers taking up the service after, July, 1995, are concerned-admits to res

ponsibility or liability for damage to apparatus done by fire, flood, or any other nach calamity. In regard to subscribers already connected with the telephone service prior to July, 1925, no new arrangement appears to have been entered into with them by the present company.

Some months ago the Telephone Company issued a circular to its

The assessor inspected the premises and, while not disputing the alleged fact of destruction, is said to have found that there was no contract existing between the hotel company and the telephone company. Consequently, no cinim by the hotel for loss of and damage to telephones in the building could be entertained by the insurance company.

there appears for the first time a very important clause, which reads as follows:--

"The subscriber shall be res- ponsible for the payment of re- pairs or replacements required to damaged telephone apparatus where such damage is not caused by ordinary fair wear and tear. Damage or total loss due to fire, water, collapse of buildings, or theft shall not be considered as ordinary fair wear and tear, and the subscriber shall pay for the cost of making good such damage or ices,"
