RESERVISTS.

The Government fizette contains the draft of an ordinance to amend the Jury Ordinance of 1587. The "objects and reasons " given for the proposed dimendments are in the main the rigidity of the present provisions which have been not! only inconvenient but have at times made a proper consideration of the points arising on the lists of juriors very difficult.

According to the existing ordin ance, the Special Jurors List and the Common Jurors List for any particular year must be brought into force on March 1, and, the list of persons liable to serve must be posted up outside the Courts of Justice on or before February 1. There is no power to extend either of these dates. The amending bill gives the Governor power to extend Road commencing at the east boundary of the Royal Naval ATthe dates in case of necessity, and sonal Yard, running parallel with transfers the duty of the final settle lative Council to the Governor-in- Hennessy Road and terminating at ment of the lists from the Legis- the junction with Percival Road.

Exemptions Altered,

The amended bill makes it clear

that members of the Hong Kong Police Reserve are not to be exempt from Jury service, and omits the word "Dissenters" in the clause referring to ministers of religion. on the ground that as there is ho established church in the Colony there can be no "Dissenters."

Disagreement of Juries.

The question of the power of the Court to discharge the jury in cases where they cannot arrive at an agreement has also been elucidated. According to the ordinance, a jury can be discharged and a new jury empanelled, if they cannot arrive at a verdict before all the other cases for trial at the same session have been disposed of." The word Road commencing at Johnston"session" is not entirely clear, but Road, running paralled with Luard even if it means only a day' sitting, Road and terminating at its junction with Gloucester Road.

case may easily arise where it would be unnecessary to wait to the end of the day before being sure that the jury could not agree.

Aguin, it may be doubtful when the point of time is reached which is described by the words "(when) all the other ensés for trial at the same sitting or session have been disposed of." For example, two cases might be down for hearing on a particular day and only one might be disposed of on that day, or neither case might be finished on that day.

The re-wording of this section will mean that the court will have time when satisfied that the jury cannot agree upon a verdict.
