Question Of Treaty Obligation In deciding a case like this, the first question for the Court to con- sider, is whether China is under any treaty obligation to hand over to the Hong Kong authorities a person who is alleged to have com- mitted an offence there, and over whom this Court, by virtuo of the Criminal Procedure Act, article 21, has jurisdiction. "At present, there is not in existence any sex- tradition treaty between this coun- try and, Great Britain. The only treaty provision concerning this matter is found in the Treaty of Tientsia, 1858, which, inter alia, stipulates:

"If criminals, sübjects of China, shall take refuge in Hong Kong, or on board the British ships there, they shall upon dué requisition by the Chinese au- thorities, be searched, and, on proof of their guilt, be delivered up.

This looks pretty like an unequal treaty, as it imposes on the Hong Kong (mind, only Hong Kong) Government, an, obligation to de- Rver up Chinese-criminal" who commits an offence in "Chiña, “but no mention is made of circum- stances in which'a British criminal takes refuge in China. Since Great Britain, on account of the extraterritorial rights en joyed by her nationals in China, is not in a position to reciprocate by surrendering bar subjects to China for crimes committed here, she is, naturally, unable to request China to deliver up Chinese subjects for
