A grave problem has arisen in. Shanghai due to, the refusal of the Provisional Court, now presided over by Chinese judges, to back up the police in dealing with the agitator, class, and, in fact, all delinquents who are members of guilds and unions. This question of the "weaknen" of the judget has been given promia- ence in the Press on several occasions, but the proceedings last Thursday reached a climas. The matter is vigorously dealt with in the North China Daily News" by Mr. Rainey Gilbert, part. of whose article we give below: The obstacles which the Provi-| sional Court puts in the way of the maintenance of order by the Muni- cipal Council and the Police were fully illustrated yesterday in the case of a labour agitators, caught in the act of inciting, a strike with incriminating literature upon him, writes, Mr. Rodney Gilbert in the North China Daily News of last Friday. The evidence against him was overwhelming, the judge him- self tripped the defendant up several absurd lies and made his guilt clear to all present but the

case was remanded sine die.

This was not as spectacular an affair as many that have preceded is but it was such a clear case that it served to prove better than some of the more sensational ones, how impossible it is for the police to function efficiently while this far cical court stands between the Coun- cil and the execution of justice as an obstinate barrier.

The attack on the sa Sunning by pirates last November 18th, when the vessel was on her way here from Shanghai, is still vividly impressed upon the public memory. The subsequent trial of the men arrested, the execution" "of the guilty and the last fling made by the two of them while awaiting execution at the Victoris Gaol were the leading episodes of that grim drama: Now the curtain has been rung down.

Two of the pirates were landed, desperately wounded, and, unfortunately for them they covered in the Government Civil Hospital. They were subsequently the last Supreme Court when arminged before the judge at the Criminal Sessions were held and duly convicted.

since then and yesterday morning just at the break of day, they were taken out of the condemned cell and
