Marine Lot, containing 9.769 superficial feet, for which he pays £73. 13.1 per annum. He obtained the Land from a Mr. Holgate, to whom it was allotted, under Mr. Johnson's Regulations, which required the allottee to make a fixed annual payment of £1 for 129 square feet.
The sum which Mr. Scott has been called upon to pay is a Rent; and as no reduction was reserved at that rate, we do, with agreeing authorities, think that sufficient reason is assigned for any reduction. We would submit that the present Rent should be maintained.
We think it unnecessary to advert to the different Regulations of Captain Elliot and Mr. Johnson, under which Land was granted on the first settlement of the Island, and with reference to which a different practice has been observed in apportioning the rent, as noticed in the present Despatch, since the Case seems simple, and may be disposed of on its own merits.
