The only alleged proof against the accused was based solely on the evidence of Tam Lay, who said that he was in his employ prior to the alleged attempt at fraud. This witness had saul that he hat been employed by the nccused, until June sth. 192

It was, however, going to be shown that Tam Lay was never in defendant's en~ ploy, and consequently his evidence was of no value. He said that the accused and another man had a business, called the Chung Wah printing press in Canton in 1994 In fact accused did have'n busi ness in the street mentioned in 1922, ht! | had so printing press. It was in the middle, of 18 that he actjured, such a business, and although the transaction waa begun on April 30th, 1925, he did not actually take it over until sometime in May. Continuing, Counsel said that a person of the name of Leung was employed by the accused, but Tam Lay bad said, thub he did not know him. That proved that he was never there, and that his story was wholly a matter of imagination,

Mr. Jenkin submitted that the internal evidence of the book was unknown.
His Lordship: What then is your ap plication, Mr. Jenkin?
The second witness who had given evidence against the accused was Chan Shain, formerly a solicitor's clerk. He had said that he had known Lam for many years, and that he had seen him in the first prisoner's house. The first ne- cused had stated in evidence that he had never even mentioned the naine of Lam to Chan Sham. Chan Sham had also mentioned that he had gone the Bank of East-Asia with Lam to borrow money frou a person named Ho, for the purpose of pushing on the civil action. The second accused was going to prove that he did not know this man. As the nature of a long adjournment. He real secution had not called upon Ho to give evidence, the defence were going to call him. He would prove that Lam neyer visited the Bank, and that in fact Lan never knew him.
Mr. Jenkin ly application is that should be supplied with a translation, or that I shall have time to get a translation of the book. It might take three days. It is the first I have heard of this book and the defence had two months to give. me a translation if they decided to do so.
A witness from the Wing On Bank had said that he had found a document at the place where the second accused was of little arrested: The document was importance. but accused was going to deny that be knew anything about it.
Mr. Alabaster then called Lam Fouk Cain, his client. He stated in evidence that he was a partner in the Wah Hing Photograph Co. in Des Vaux Road In 1923 he became interested in a business in Canton, known as the Chung Wat Lithographic Company,
He further stated that Tam Lay had never been employed by him. A

His Lordship said that it was a matter for strong comment. The predicament of the prosecution was the result of the pro- cedure in criminal cases. According to that procedure the prosecution does not know what the defence is. He did not think he could give anything in the

Mr. Jenkin remarked that if they were sitting in England and such a document were put in in French or Spanish or in any language which English counsel could not understand, a translation would be necessary. He pointed out to His Lord- abip that if the case were adjourned at that moment until next day, he could not get one third of the book translated.
His Lordship: I cannot see how I can give an adjournment in this case every time a new book is put it.

a translation should have been supplied.
