On the 28th September
was
brought before
the Chief Magistrate and the Depositions taken. These were
only submitted for the
Consideration of
the Attorney
General who stated that,
in his judgment, "the offences
"having been alleged committed
by aliens
on board a
Foreign Vessel, the Courts here
"have no
jurisdiction in the
"Case", and, under these
circumstances, I have consented, at the request of M. le Baron de Forth Rouen, to hold these
men in
custody, until he can
receive an
answer to
a reference which he proposes
to make to his Government on
the subject,
or until the
arrival of a French Vessel of
War which he states will come to
receive them. At present
there is
no French Vessel of
War in these Seas.

I have considered it
my duty to detain the accused Chinese in pursuance of the authority
to that effect contained in the Act of Parliament 6 and Victoria Cap: 75, entitled "An Act for giving effect
"to a
Convention between Her
"Majesty and the King of the
"French for the apprehension
"of certain offenders."
