preventing intermediate buildings being erected, entirely disconnects the hitherto suburbs from Town, making the distance between, lonely at Night and monotonous in the day. The first of these Marine Lots, 1225 I bought second-hand with the Buildings on it; the others at a Crown sale this year;
there had been sold before and surrendered; I really cannot tell why I bought the most part of these latter Four Lots; they are for the most part still void; annexation to the Marine Lot 1225, combined with a latent disease in the Brain, or an enlarged Bump have been the cause.
There is blame to my charge, I admit that myself like others, buy Lots as depicted in the colored drawings of the Land Office without inspecting the Land. Marine Lots 1225, 29, 29A, 30, and 30A, one and all, are seven or eight feet below the level of the Queen's Road, the footpath whereof, day by day falls into them for want of a retaining Wall; and, what is worse than this, the Sea at High water comes within fifteen feet of the said footpath, yet am I said to enjoy a boundary of Fifty feet from the said footpath to the Sea. On one occasion I remember I felt so much aggrieved that I refused payment of Rent on a Lot similarly situated, and when summoned before the Court, in reply to any argument that at the Crown sales I bid for the Land, the Judge silenced me by deciding that I had more than I bargained for; I had the water and the Land under the water. These Lots are the Beach, and more or less covered with every gale; they are neither water nor Land nor under the water. I beg that it may be represented that, if I carry Ground from a distance to make these Lots, that consideration should be made therefore. As well as in respect of its suburban Locality.
Inland Lot 1138, situated opposite Pedder's Hill, circumstances connected with a proposed Theatre, induced me to pay a sum of Seven Hundred Dollars for this Lot to a Land speculator: it was then
