square fort, only available for gardens, charged with the annual rent of upwards of £42, whilst the triangular space of ground within the lines DFF' is that, out from the advantage of a Marine lot, though charged with rent as such, and thus pays £50 per annum over and above the rate it would be liable to as a lot, to which class it more properly belongs.

The upset price for Marine lots was, I believe, obtained from the average sale prices of lots 100 water feet back to the road, running almost parallel frontage, going with the water frontage, 3, and which depth of lot, I think, in the generality of cases, will be found to have given an average of not over 150 feet from north to south.

The eastern boundary running north and south of Lot 44 to the lot as originally measured is 330 feet. Thus, owing to being considered a Marine lot from high water mark to the road side, and the road not being continued in a line with the formation of the harbour, and therefore not parallel with the water frontage of the Lease, as in most all other Marine lots, I am charged with the Marine lot rate for a piece of ground CFGH that, had the Road been continued in a line with the harbour, would also only have been a Town lot, and I should not have been taxed with more ground rent for the road-side house, because it was at the north side of the road, than houses situated at the south side of the road.

It will be observed from the plan that, taking away the triangle DEF and the piece CFGH, I am still left a Marine lot of 100 feet frontage, almost the exact size and contents of my neighbour, but about 5,400 square feet of which were unavailable for building ground when the lot was sold. As the upset price of the land per square foot was fixed upon the average purchase price per lot, marked out as nearly right angular as they could be, and unavailable for building on, bought with no useless angles unavailable.

I conceive that the ground within the letters AGHB is the just formation and size of the lot to which that upset price is applicable.

I would respectfully, therefore, submit for your consideration, with reference to the tenure of my lease for Lot M 44:-
