AN EXTRAORDINARY STORY.

CAPTAIN OF THE "W. H. TALBOT"

PLEADS GUILTY, --

The trial of Capt. F. H. H. Borregon, baster of the American schoocer * 1. Talbot, which entered Shanghai early this summer with one of the largest con- Signments of sanggled Brought into. China, commenced before Judge Milton D.Pundy in the US. Court for China on December-Send.

BERGS evor

1 The U.S. District Attorney. Mr. Leonard G. Husar, presented no case, s the accused Captain, represented by Mr. H. R. Snyder, of Fessenden, Hof- comb and Snyder, pleaded “Guilty" to the charge of unlawfully bringing the

arms into China.

Mr. Snyder briefy drew His Honour's attention to the fact that "Capt. Borrçson Bad been in custody for 62 days, and at the time of his arrest had expressed will. ingness to turn State's evidence and assist in every way possible to effect the arrest of the others concerned in the gun. running scheme. Moreover, it was his first.criminal offence, and: Counsel point- ed out that the accused had morely been the cat's w

of others, and was in very urgent reed at the time the pro- position was made to him."

The District Attorney added that the acensed 'actually had assisted the U.S. Marshal in his endeavours to locate the other smugglers concerned. He had also bera in gaol, and though technically guilty was really not so much to blame as others.

Mr. Snyder asked for a fine and the smallest possible sentence.

His Honour, the Shanghai Herturg report says, subjected the captain to a lengthy

cross-examination concerning the circumstances surrounding the hatch- ing of the plot to bring the arms into China. Capt Borreson stated that he was born in Germany 44 years ago, and had been at sea for 38 years. He became a naturalized American in 1909. He was Brst given command of a vessel in 1904, and traded principally between "San Francisco and Australia. A party of Chinese in San Francisco's Chinatown, and white man i named Swinebari (now living under the name of Rolfe as the Baldwin Hotel, San Francisco) Erst proposed that he should bring the arms to China. They promised to buy him a ship.if he would do so. He first met ther two years ago, and had been continually in touch with them in San Francisco until be sailed for Shanghai at the be- ginning of this year. There were about ten or twelve Chinese in the party in- cluding Charlie Gum," 20 well-to-do Chinese and the manager of a grain-store in Ross Alley, Chinatown, San Fran cisco. Charlie Gum" said they had a lot of arms which they wanted to ́get to China, and arrangements were made

Dugly. The . H. Talbot was sapreted by Swinehart and the group of

Botrison was given command and secured a cargo of lumber from Koo's Bay Oregon, to bring to Shurg hai as legitimate cargo.

The guns were placed on board by Chinese fishermen, who came alongside the ship in small steam launches in the dead of night while the crow were all absent. They placed on board altogether 83 cases, mostly German Mauser pistols. These were stowed in the aft peak and covered over with rewood. Swinehart and the Chinese who financed the expedi tion were on board supervising the oper ations. When the Talbot sailed from Koo's Bay in April last for Shanghai, the crew were not aware of the illicit cargo on board. There was a hitch in getting the ship's clearance papers, and it was found necessary to sail without them, Swinehart promising to forward them on to Shanghai almost immedinte- ly

Borreson said he was to get no other reward than a G.915,000 cargo to return with to Atherica He received no salary, and only $250 for personal expenses.

GUNS SOLD OVER SHIP'S SIDE IN SHANGHAL Upon arrival in Shanghai the Talbot berthed of the Robert Dollar wharf. The cargo of lumber was 'corsigned to Jardine, Matheson & Co., and was short- ly afterwards delivered. The Captain found thas neither money nor ship's papers had been received in Shanghai for him, and he wired to Hongkong to Charlie Gum," who had arrived in the Orient to receive the arms, which were intended for Hongkong.

- UP COUNTRY MORE FAR." A reply came from the south saying that Charlie Gum was up-country. Accused then held a conference ‘in the Eastern Hotel with a number of Shang- hai Chinese, when 'he' was told that naveral of the San Francisco party had arrived in Shanghai also, but these people, the captain mid, he never saw." It was explained that arrangements had been made in Hongkong to receive the arms without difficulty...

While these matters were being adjust- ed on shore, the Acting-Chief Mate broke into the arms on the Tolbal and sold a large number over the side of the vessel to Japanese buyers, who came from the | shore. It was thus that the arma were discovered and confiscated by the Cun- toms authorities in the Captain's ab
