The Editor replied: At common law it is clear that there is no cetigation upon any person to do any act, even the sIMP- fest, to save the life of another person. anthough is must be obvious both at the time

of the emergency and afterwards that the act of life-saving would not in volve the slightest risk to the possible We have unfortunately plenty of instances where such inhumanity has been

Special laws, indeed, there are which make tribunal an omission to do a fer- un thing which is intended to usure the safety of bie and time. Anke, for San. example, the Statute and Vict Cap. 100, whien by Secion 25 makes it un offence in certain circumstances for a master or mistress to neglect to supply their servant, or apprentice, with ueces saries so that the he of the dependent is endangered or there ensues. risk ot' per- by Section 31 maneat injury to health.

Again under the Coal Mines Acts, 1911 and 1814, persons employed in, or en gaged in the management of, auch mines as come within the scope of these Acts are punishable for neglects and or omis sions which are likely to prejudice the wafety of persons working in them. Then there is a considerable body of legislation in regard to the precautious to be taken for the safety of workpeople employed in factories and neglects and omissions bere also are punishable offences.

Then, turning to the sea, we have the obligation upen the master of every vessel which gets into collision with another vessel, under Section 422 of the Merchant Shipping Act, 1854, to stand by and assist the vessel with which he has "collided. Until the year 1911 it was enacted that failure to stand by in such cases should place upon the defaulting vessel, in the absence of reasonable excuse for the master's conduct, a presumption of res- ponsibility for the consequences of the casualty. Though under the Maritime Conventions, At this presumption longer exists, the obligation to stand by still remains

NO OBLIGATION TO PROTECT.

We have set cut so much of the law be Cause we want our correspondent, and these other readers who are interested in the question; to appreciate that, as we have said, there is no obligation at com mon law upon say person to do anything for the protection of any other person. In all the cases which we have mentioned where &atutory obligation has been placed upon a person to avoid neglects or omissions, it will be seen that there is a cortaja relation

between the possible offen- der and the person whom the law secka to protect, and it is the existence of that relation which justifies the legisla ture in breaking in upon the old common law exemption. The people who can bo prosecuted under these Arts are parents and guardians, masters and mistrcases, managers and fellow workers. we think we the have established the fact that, in absence of statutory enactment, there is no obligation, even on one who stands in a sort of fiduciary relation to another, to protect him. That being admitted, we fear our correspondent has little hope of saccess in his proposed suit. There is no statutory obligation on a shipmaster fo take steps to pick up a man who goes overboard. One is almost inclined to ask whether such an enactment would ever be necessary. CINEMA NOTES,

THE WORLD TELATEL Universal City officials have declined to explair, how the San Francisco earth- quake and fire and the actual demolishing of an entire section of the city was obtained as the climax for pictures which is showing at the World Theatre to-day. The production is The Shock

and

those who have viewed it state that the San Francisco earthquake scenes are either geniune views of the great catas trophe or that a section of the city was rebuilt brick for brick and then wrecked. It is one of those dramatic motion pic tures that combine thrills and real acting ability, coupled with a real story. It shows the power of love upon a man who was a moral as well as a physical cripple. The leading male role is taken by that master actor, Lon Chaney, and the giri in the case is played by Virginia Valli, one of the most beautiful stars in pie tures. It is a picture that you will enjoy and marvel at.
