"American lawyers," he said, "like their brethren in all democratic coun- tries, have from the beginning played a prominent and an effective role in pablie affairs. Haznilton, who exercised a pro- found influence où the deliberations of the Constitutional convention which settled the distribution of powers between the Federal and the State authorities, and Lincoln, who played the decisive part in the struggle over State rights, as well as their chicl axxociates, rivals, and oppon- ents, were hetive and successful lawyers. 19The predominant position and in 'fluence of lawyers in public affairs in the United States is due primarily to indivi- dual character, intellect, and power; but there are special characteristics of the American system of Giovernment which have offered a favourable held for the talents of public men who have undergone the discipline of the law and possess a competent knowledge of it

in that system, no legislature, either Federal or State, possesses even thrure- tically the unlimited authority of the Parliament of the United Kingdom. Nor, indeed, do all these legislatures combined. The theory is that sovereignty, buth legal! and "jiolitipal, resides in the people,and | that the legislatures possess such author- ity as they have received by a grant frang the people, this authority being defined expressly or impliedly in written constitu tional instruments.

The constitutional limitations express ed in these instruments include, for example, guarantees of Magna Charta for the security person and property, and by force of such limitativas legislatures are disabled from enacting legislation repugnant to them, and legislation is void which, if operative, would have such an effect. Such limitations have at times been rather broadly éonstrued, and against the American courts more than once a charge has been levelled that they have so interpreted them as to erect them. into barriers across the path of progres- sive legislation

Some years ago, it will be renirsuber- ed. President Roosevelt initiated'a famous" propaganda for the establishment as"A constitutional practice of the recall' of } judges, whereby, in consequence of a plebiscite, those whose constitutional in- terpretations should be too reactionary might be disciplined by a popular vete and removed from office. The American people did not welcome this view. The elements of their constitutional system. under which rights of property are made absolutely secure from invasion by a legislature momentarily under the sway of epub feeling or tumult, seemed to them too precious to be abandoned, even though their maintenance should seem to entail some sacrißer to flexibility and adaptability in the legislative machinery,

In a country in which public issues are often complicated by questions touch- ing the scope of such limitations upon the powers of the Legislatures under this system, as well as by questions relating to State and Federal prowers, it will easily he understood that the position in public life of the adequately equipped lawyer of character and ability must be a command. ing one.

"Legal questions always present a great attraction to the English democracy in America, and Burke declared, in his speech on conciliation with America, that a large number of copies of Blackstone's Commentaries have been sold in the Com- monwealth of Massachusetts alone than in the whole of the United Kingdom. And, indeed, the great historical con- troversies in which the feelings of the American people have been most kecaly engaged have been fundamentally con- troversies about jegal and constitutional questions. In the speeches of great lead ers like Webster, Lincoln, and Garfield, such questions are discussed with opal- ence and power, and their speeches have exercised an extraordinary influence on popular convictions.
