DEBATE IN THE LORDS.
An interesting feature of the' and reading debate on the Criminal Justice Bill on February 28th was the divergent views expressed by legal luminaries in the House of Lords upon its provisions.
The Lord Chancellor dwelt especially upon Clause 24, which deals with the pre umption that an offence committed by s wife in the presence of her husband was committed under his coercion. That presumption, maid be, was a very old one. It held good in all ponaltics except murder and treason and in the case of all misdemeanour. If the doctrine held trus in the past it was not true to-day, Speaking generally, be considered that wires were free agents. The question of their guilt or innocence ought to be considered on facts and not ander such a presumption. There had been several cassa in recent times where a Judge bad felt himself bound by that rule to direct the acquittal of the wife. He did not say that in these cases the jury would have convicted the woman, but he was quite sure that in some of these cases, at all events, the Judges would have preferred that the matter should have been left t the unfettered judgment of the jury. In his view the presumption ought now td come to an end. It had no relation to tha realities of the present day. He was not sure, however, thataif coercion was proved it should not continue to be a defence.
Lord Buckmaster joined issue with the Lord Chancellor over the question of the coercion of wives. He pointed out that for eleven hundrol years down to the present time it had been a rule of the low that if a woman committed a crime in the presence of "ber husband she should be assumed to have committed it as the re- salt of his influence, and consequently could not be independently convicted. The influence which a man exercised over his wife was one of the strongest influences that existed in the world. They might give the vote to woman and seats upon the Beach and other liberating measures, he said, but her nature would remain the

Viscount Haldane poisted out that it was not a question of doing away altoge ther with the defence that arine was committed under the coercion of the bus band, but of learing it to the jury to decide whether or not there had been coercion.
Viscount Ullswater said that in 1878 a very powerful Committee had reported in favour of the abolition of the presump. tion that the wife acted under the coercion of her husband, and quite re cently another Committes had reported in the same direction. It seemed absurd for Lord Backmaster to pre- tend that the presumption was in accordance with facts which were "well known to all of them. The presumption was strongly resented by the advocates of women's rights. If they were to maintain proper and due respect for the law ther must embody the customs, and rishes of society of the present day, and not of 1,100 years ago. If a woman could prove that she acted under the coercion of her husband there was little doubt that the jury would acquit her.
