It is on account of this agreement that the allegation is made that the Japanese are seeking a monopoly of radio communi- cation in Chins in defiance of the previsions of Article 3 of the Nine Power Treaty con cerning China, signed in 1922 at Washing-system for the operation of the service in ton, but that this allegation is entirely question.DALENA unfounded may be proved even by the Nine

Power Treaty.

"In the first place, the Nine: Power Treaty, not in force yot, provides for the future for the principle of the Open Door or Equality of Opportunity in China for the trade and industry of all nations, and No it cannot affect by any means the contractual rights of Mitsui and Company existing many years before the signing of the said Treaty.

In the second place, supposing for argament's sake, that the Treaty might have any effect upon the contract, the exception to the said general principle should not be overlooked. Article 3 of the Treaty reads:

With a view to applying more effectually the principles of the Open Door or Equality of Opportunity in China for the trade and industry of all nations, the contracting Powers, other than China, agree that they will not seek, nor support their respective nationals in serking.

(a) Any arrangement which might purport to establish in favour of their interests any general superiority of right with respect to commercial or economic, development in any desigunted region of China

(b) Any such monopoly or preference La would deprive the nationals of Buy oiber Power of the right of undertaking any legitimate trade or industry in Chine, or of participating with the Chinese Government, or with any local authority, in any category of public enterprises, or which by reason of its scope, duration or geographical extent is calculated to frustrate the practical application of the principle of equal opportunity,

"It is understood that the fore-going stipulations of this article are not to be so construed as to, probibit the acquisi- tien of auch properties or rights as may be necessary to the conduct of a particular commercial industrial or financial undertaking cr to the encour agement of invention and research "Whatever kind of assertion might bo put forward against the contract, the inter pretation of the last exceptional clause is made too clear to admit any misunder standing or misrepresentation by the statement made ia very explicit wording on this subject by Earl Balfour, and also by Mr. Hughes at the Washington Conference. The Minutes of the Eighteenth meeting of the Committee on Pacific and Far Eastern Questions contained the following passage Conference on the Limitation of Arma- ments," Senate Document No. 126, Govern- ment Printing Office. Washington, 1922, p. 617):-

"Even in the fight of the Treaty and the resolution signed subsequent to the signing of the contract in question, it is quite clear that Mitsui and Company are justified in insisting upon their contract rights to their full

to secure the revenues of the wireless repayment of the station and the capital and interest The object of the arrangement in question was in effect to secure for the Chinese Guvernment the financial success of the radio station, whereby to ropay the capital invested in the enterprise. It is thas a lawful and legitimate business contract to protect the interests of the contractors as well as the Chinese Government.

"As to the mischievous rumour that the castruction work has been a failure, suffice it to say that the wireless plant, after being put to a trial test, will shortly be in working order."-Router.
