MY WIFE'S KEEPER.

Cont

[BY A "HUSBANDK]

Twice recently High Court judges in London have been obliged to apply the Tegal doctrina that a husband is liable for the "torta" of his wife. "Torta" are sometimes explained by the statement that they are not contracta' or crimes, but injuries caused by negligence, muisance, frand, slander, trespass, and the lika

In one of these cases the wife's "sort") cost, the husband £86 and costs, and many A husband, remembering his own periences of the same law, will regard that sum sa trivial by comparison.

As it stands, the law in England is perfectly clear and entirely satis factory. Why, it may well be asked, should a man have to pay for dituage caused by a wife's slanderous tongus? It is a grows man's task to control his owo, and it is preposterous to imagine that any man by civilised methods can modify the flow and quality of his wife's speech.

The doctrins rests on a decision of the British Court of Appeal delivered soon | after the pasing of the Married Women's Property Act in 1883. That decision has since been adversely criticised by judges and shinent lawyers; notably by

the late Lord Moulton, who, although DAIRY FARM NEWS bound by the decision, expressed the strong and pious hope that it would soon be reviewed by the British House of Lords.

Yet since 1853 the Lords have never had an opportunity of setting it right.

Why should the husband be held liable? Because under the old law a married woman was incapable of being sued alone. She was hardly recognised as having any existence apart from her husband and it was necessary to join him in any action against her.

This inability was removed by the Married Women's Property Act; bat the strange and apparently unjustifiabla distinction remains between torta, and contractá.

It may be that there is a theoretical justification. Certain vid and authentic rocords of Colchester in England show conclusively that in the view of mediaval judges a husband was held Hafla for his, wife's misdeeds- on the ground of negligence.

He would by proper teaching and chastisement bring up his dog in such manner as to make him a good dog. In this antique view he had equal- “power and authority over his wife; and if she caused injury and damage by her wrong. ful acts it was because the Husband had failed in his duty to correct, admonish, ami chastise.

To modern women and men this view may appear ludicrous, but it is probably the best record that can be found for the existing law a to a husband's liability, and is surely not more offensive than the flaw itself.

It is obvious that in law the sexes are still inequal and that the inequality is not always in favour of the male-From a London Contemporary.

Mr. Justice McCardie retorted that it would not increase the happiness

Mr. Justice McCardie said that in addition to the legal aspect be wanted to study the social aspect of the case; and he reserved judgment.

WOMEN'S SUFFRAGE REJECTED IN SOUTH AFRICA.

By crates to 53 the second reading of the Women's Entranchisement Bill- was rejected in the Union House of Assembly, Cape Town, on February 1st.

The division shows that the measure is gaining adherents every year. With the exception of Mr. Jagger, Minister of Rail. ways and Harbours, all the Cabinet Ministers, including the Premier, General Smute, supported the bill. The opponents were mostly Dutch members, who claimed that the rural women folk, were opposed to the vote. It is noteworthy that Mr. GH. Nicholla, member of Zululand, recanted his support of the proposal to give women the vote on the ground of "the danger of introducing democratia novelties in a country governed by a white aristocracy" and of the importance of maintaining the white's prestige.-Reuter.
