A somewhat unusual case, and one of special interest to Straits-bora Chinese came before Mr. Justice Barrett Lennard in the Supreme. Court, st. Singa: pore, last week. According to the orthodox custom: the bridegroom approached a sooth-sayer or astrologer to fix the lucky day and this was fixed for November 1st. This was communicated to the bride's parenta who issued invitations for the wedding to take place on that day. A few days before that date much to the surprise and disappointment of the bride's parents, they received a letter dated 19th Novem bor from the go-between in Romanised Malay the contents of which were to, the effect that defendant's mother did no wish to light the candles and that bó had nothing to do with the affair. If they wanted to know the reason why, ho would tell them that evening. That was followed by another letter dated the 16th November in English, in which defendant said he had written the go-between " to get back his "pock-geo" or horoscope and return it to him. Mr. de Mello said he submitted that was a breach of the promise.
EXPENSE AND INJURED FEELINGS..
On receipt of that lester. Mr. de Mello said, his client wrote drawing attention to defendant's promise to marry his daughter on November 21st. There was a reply from the solicitors for defendant dated 18th November in which they stated that their clicht was emplayed by the A.P.C. and they had handed him. Chia Teck Lye's letter and their instructions were they had to inform him that de fendant had never agreed to marry his daughter, and he was at a loss to under- stand why arrangements had been made.
Mr. de Mello said his client went to a considerable amount of expense. They hired a house which they had decorated. They also hired a number of musicians, and a number of invitation cards were sent out. Clothes and jewellery were also bought and the total amount actually spent was roughly $1,117. by reason of the promise of marriage.. Mr. de Mello said that plaintiff being an infant they could not approach the Court except through her father. He could not. say that plaintiff had spent the money her Belf. Then there was however, an ele ment of injured feelings,
His Lordship, in summing up; referred to the fact that the plaintiff had never spoken to the defendant right up to tha day when the alleged rupture took place. She had no affection for him whatever; } so obviously there was no claim for: dau ages for her feelings being outraged. The second point was, on the grounds of loss of social position. or wealth, but in the present onse nothing had been said on that point. His lordship said he did not propose to place on the defendant a heavy obligation than he hoped he would undertake to pay. That might be done by directing him to pay the costs of the action.
Defendant was given fourteen days in which to pay.
