SEQUEL TO ATTEMPTED KISS. EX-OFFICER CHARGED WITH
ASSAULT AT SHANGHAI, MAGISTRATE'S STINGING REMARKS,
An extraordinary caso of assault at the Palace Hotel, Shanghai, was the subject of proceedings in H.M. Police Court, nat week, before Mr. G. W. King. The cont plainants were M. Jean Pernod d'Acriere and his wife, Madame Therese Pernod d'Arriere, and the defendant, F. B. Chap- man, who is staying at the hotel, was charged with having committed an assault upon both complainants, causing actual bodily harm to M.-Pernod.
Mr. K. E. Newman appeared for com plainants and Mr. Lindarger for de- fendant.
In opening the case, Mr. Nowman stated. that complainants were distinguished French visitors passing through Shang bai. On Tuesday they spent the evening at the Palace Hotel, and "after dinner Madame Pernod left the dining room to go to her room on the further foor, There were two men in the lift as she went down, and one of them, the defendant, without any warning put his arm round ber and attempted to kiss her. She push ed him away and he then hit her on the face with his fat, shuning her nose to -bleed. Very excited, she got to her room, the two man following. At that moment her husband came down the corridor and asked what the two men were doing They slipped away and separated and, naturally infuriated, M: Pernod rhin to find them. Ultimately, he went to the bar upstairs and he had only half opened the door when he received a smashing blow on the head from a champagne bottle. Neither complainant nor his wife | had ever seen the two men before. Just before the assault, defendant went into the bar and asked for a bottle. The boy refused to give him one, whereupon de fendant threatened that if he did not hand one over something would happen. The boy then gave him a bottle and ran away.
-COMPLAINANTS' EVIDENCE Madame Pernod then gave evidence, stating that she was a visitor to Shanghai on her way to Tieptain and was staying at the Palace Hotel. When the accused tried to kiss ber in the, lift she slapped bis face. The other man did nothing, and she asked him if he allowed a man to beat ́a woman. He replied that he was an American: The two men followed her into her room. After having washed the blood from her face witness followed hef hus- band, who had gone upstairs to look for the two men, and she saw him lying on the floor at the entrance to the bar fook- ing like St. John the Baptist in a pool of blood." Since the assault, witness had vomited blood and suffered frain Bervous breakdown.
Mr. Linebarger did not cross-examine. M. Pernod gave corroborative evidence. Accused was standing behind the door when he struck witness with the bottle. He was examined by Dr. Gauntlett, who. had seen him every day since. The wit ness was not cross-examined
The lift boy identified defendant as the man who assaulted the lady in the lift.
