HOMUNTIN CASE.

The Puisne Judge (Mr. J. R. Wood), following his verdict for the plaintiff,- hna delivered a considered judgment in the Hamuntia Bungalow case, in which the Rev. Father Henriques sued Mr. G. T. Lam for compensation for damage, to his property, alleged, to be due to the defendant's building operations:

The parties are adjoining owners on a site which had been filled in. The plaintiff built a bungalow on his portion of the ground; the defendant, later on, put up a larger building. The plaintiff's boundary wall then gave way, and he suggested that the weight of the defend- ant's building, had caused compression of the soil, with the result that the foundations of his wall were shifted.

The amount of the claim was only $200, 'or no; but a great deal of expert evidence was called, pro and con, and the hear- ing lasted many days, one of which was spent by the Court on the site itself.

THE JUDGMENT,

After discussing the various expert theories put forward, the Paisne Judge said:-The theory which seems to me most convincing, and most in accordance with the facts to be observed on the site, is the last, viz., that the settlement of the soil under plaintiff's boundary wall, which, led to the injury, was mainly" caused through compression, by the defendant's building.

The defendant had a duty to the plain. tiff, in building, to exercise ordinary care to prevent injury ensuing to the plain- tiff's property. This is an absolute duty, indicated by the circumstances in which the parties acquired their properties. The particular act of negligence which I find proved against the defendant is his failure, to erect his building on a hard foundation. Mr. G. G. Wood, architect, in his evidence, stated that he himself, had he been advising the defendant, would have insisted on taking the founda- tions down to hard ground (13 feet at the deepest point); or he would have in- sisted on reducing the size of the pro posed building. The compression of the soil, caused by the erection of so heavy 4 building on a foundation which was mainly on soft ground, is, to my mind, an affect which should have been fore seer and prevented.

I have found that failure to take thess precdations has been the cause of the injury to the plaintiff's property. In my view, this failure constitutes actionable Faegligence.
