At the Marine Court yesterday morn ing, were arraigned before the Marine Magistrate, Captain B. R H Taylor RN, nian West Indian members of the crew of the ale. Kazembe, Captain E. E. Egerton, Master, charged with having, on the 97th of April, while the ship wis at Manila, P.I., refuses to turn to when qrdered to do so by the boatswain. The men were shipped in the United States; being British subjects, however, they come under the jurisdiction of the Colony in this case..
The man claimed to have been threaten ed at various old times with personal violence by the boatswain, which they re- ported to the Captain. The matters Involved were investigated by the British Consul-General in Manila, but as that time, it was evidently considered to be a matter of no moment. The refusal of the men to turn to occurred, just as the ship was about to leave Manila for Hongkong. The defendant based their defence-upon- the facts that they considered it dangerous. for them to sail ander the boatswain "in view of his threats, and that they did not refuse to turn to, but did " refuse to turn to ander the boatswain."
The Master of the ahip testified that on or about the 15th of April, while the ship was at sea, the boatswain complained to him that the men wouldn't do their work He said that be called the men aft and read to them the Shipping Act, describ ing the punishment for disobeying ordera. The men went back to work, but the nett day came to the Captain and stated they 'wouldn't sail under the boatswain and intimated that they should be discharged în Manila, they claiming he had sworn at them and threatened the life of one or more. The Captain pointed out the un- rodsonableness of their demand to the men, which would involve his compan paying the boatswain's passage back to the place of shipment, and wages, if he complied with their request, and adrised them to report the matter to the British Consul upon arrival in Manila if bey wished. This they did, but the Vice-in- sul, coming on board, after bearing, all sides of the dispute decided that the matter WLA too childish a one to permit hpn to take action.
