Sergt. Pincott deposed that shortly after 4.30 p.m. on Wednesday he was on duty on the Police launch when he heard unusual noises from the junk anchorage. The complainant, re-called, could, not. identify the man who had been arrested on the lighter as distinct from those whe had been arrested on the sampan. He denied having pointed out the man to Sergt. Pincott.
Sergt. Pincott said he was sure the com- plainant had pointed out the man in ques- tion as having been one of the thieves.
The complainant again denied this, and Mr. Lindsell therefore" discharged the mun (defendant No. 8).
The first defendang repeated his atory that he went to take delivery of rice which he had engaged to purchase from the complainant. After he had taken two bags from the lighter into the samopan, the complainant changed his mind and said he could not sell the rics to him at 311, as another man was willing to pay him $15 per pieul. When he asked the complainant why he had changed his mind so suddenly, the people on the lighter began throwing firewood and other things nt him and his coolies. Then the Police arrived and arrested them.
Asked what his occupation was first defendant said he was a truck-coolie em- ployed by a 5sh-dealer. His master in- tended to pay for the rice.
