Coming to the machinery for the settle ment of disputes, it is recognised that each State must be the final judge of whether a disputo is justiciable or not.

to some court of arbitration. In this Case of non-justiciable disputes, the

ap- propriate organ must be either the Council or the Conference of the League. For the present, however, it is considered. that all that should be attempted is to secure that in every dispute full public discussion, and the delay necessary for such discussion, should be ensured. In other words, the appeal must be to inter national public opinion rather than to formal cocroive machinery, for which the time is not ripe. In the following cases only is it proposed that the League should apply coercion to sovereign States:

(1) If an aggressive Power insists on going to war without allowing the machinery of

of the League, for securing proper discussion of the dispute, to ope rate. (2) Where one of the parties to a dispute has complied with an anani- mous report of the Council or Confer

of the League, and where the other party, nevertheless, refuses to accept this as a final settlement of the dis pute.
