The Govern- ment's reply was that they were justified in the course they took by the provisions of the Ordinance; and that the Court had no jurisdiction in the matter. The Colonial Lawa Validity Act removed all sloubts as to the right of the local Legis lature to pass any Ordinance which did not conflict with a law that had been. expressly extended to the Colony by the British Parliament. With this qualifica- tion, there was, therefore, no limit what spever to the powers of the Legislature to pass any Ordinance which in its opinion was conducive to the peace, order and good government of the Colony." If the local Legislature saw fit, to pass an Ordinance against one man personally which would deprive him of his property, his civil rights, and even his life, it had the power to lu so, subject DISTINCTIVE IN FLAVOUR, only to the Royal veto. It will be seen that the Court upholds this view, but the Chief Justice considers it most desirable' that the case should be taken to the Privy Council. According to MT ALABASTER (who, with the Hon. Mr. Wood eventually decided to take what evidence there happened to be available and then to adjourn.
Inspector Gerrard said that after the Fire Brigade arrived on the scene it took an hour to get the fire under control and about three hours to extinguish it. He inspected the yard after the fire had been put out, but he found no sign that would suggest arson, He had, however, been particularly struck by the short space of time which passed before the whole yard was ablaze, especially as there had been a fire also in the yard on May 16th, and on that occasion he had not been able to find any cause to which the outbreak might be attributed. He produced the books kept by the owners of the business.
