AN ALIEN ENEMY'S RENT. INTERNMENT DOES NOT SUSPEND

CONTRACTS.

An important judgment was delivered at the Summary Court yesterday by Mr. Justice Hareland, in the action in which Mrs. Hickie sued Messen Lowe, Bingham, & Matthews, is liquidators of the estate of 1. Beilken, an alien enemy, for the sum of 440, being four months' rent of No. 26. Belilios Terrace, for the months of November, December, January, and Feb- ruary last.

His lordship, inter alia, said-It was agreed between the parties that this nction should be disposed of by the trial of the following issue-Whether the local Government in interning the defen- dant nullifies or supersedes the contract.". I would first refer to a point raised by Mr. Dixon as to whether the potion can be maintained having regard to certain words in Section 7 (11) in the Alien Enemies' (Winding - up)

Amendment Ordinance, No. 30 of 1914.

The words are "Every liquidator shall be entitled to retain out of the assete.. (a) the rent of any business premises. formerly occupied by such alien enemy which shall accrue while such premises are occupied by the liquidater for the purpose of such winding-up."

It was submitted by Mr. Dixon that having regard to the wording of the Section, the liquidator was only authoriz

d-to-pay-the-rent of the business premises. formerly occupied by the alien enemy, but not the rent of his private-dwelling. It is very clear, however, from the wording of Section 5 b-sections 1 and 8, of the

principal Ordinance that the liquidator appointed is to wind up the personal affairs of an alien chemy, which would include the rent of his privato dwelling.

I am of opinion that this case should be decided having regard to the leading case of Parudine e. Jane (1647), Aleyn 26. His lordship read the report, which was follows:--

Mr. Gardiner salt at the outset that. he withdrew his statutary point because it was obvious that plaintiff was engaged under no agreement that his verrieg 21 hours' could be terminated with a notice. As to the question of considera- tion. Mr. Gardiner said that it had been shown that the enimpang were so much satisfied with the plaintiff that his salary was increased and he had been moved from Second Officer to Chist.

Ilis lordship observed that a 24 hours' notice seemed very extraordinary.
