A DENTAL AGREEMENT.

ACTION IN BINGAPORE.
Mr. Justice Earnshaw, in the Supreme Court, Singapore has tried an action brought by Mr. J. M. Orago against Dr. J. W. Noble in respect of an agreement entered into between them. Mr. Upcott was for the plaintiff, and Mr. Carrer for the defendant.:
There were certain agreed facts, a state- ment of which was put in by Mr. Upcott, anys the Straits Timer. Those facts who to the effect that defondant is a dental surgeon and has carried on busi. ness by himself or his agenta at Hong- kong since 1887, at Singapore sines. 1890 and at Ipoh during the last few years. For periods extending from 1890 to 1908 defendant was personally in charge at Singapore, but his head office is in Hong- kong, where he now practises. The plaintiff also is a dental eargeou, and in 1901 catered into an agreement with Dr. Noble in which he agreed to act as agent and assistant. That agreement expired in 1908 and a fresh one was entered into the period of service to be for five and a balf years. Plaintiff was employed under that agreement in Singapore and Kuala Lumpur and became acquainted with defendant's patients at Singapore. The business of the defendant in Singa pore, according to the facts agreed upon, enjoys a high reputation and is a valu able one. Subsequently, plaintiff applied to Dr. Noble for his consent, in writing, to practise in Singapore, but this consent was refused.
His Lordship asked whether plaintiff was asking solely for permission to prac tise in Singapore, and not the F.M.S., whereupon it was stated that he was already practising, the covenant being
Contract Act which prevailed there.
The action, Mr. Upcott went on, turned on one clause of the agreement, the sole point being as to whether that clause stood or fell as a whole, or whether, being invalid, it did not hold as tú Singapore. The clause in question was to the effect that plaintiff agreed that ho would not for a space of twenty-one years from the date of agreement, at Eong- kong, Singapore, or in any of the treaty. ports of China and Japan, at Bangkok, or in Cochin China, in the Federated Malay States or the Straits Settlements, without the consent in writing of the defendant being first obtained, carry on or be engaged in, either directly or in- directly, whether solely or in partnership, i or on account of anyone, other than de- fendant, the business of a dental surgeon, In the event of a breach of this agreement, the terms of the agreement were that Dr. Noble should be paid the sum of £100 for each and every month or part of a month for which Mr. Crago might have been engaged, the money to be recoverable. monthly for liquidating damages and not as penalty. The whole issue, therefore, was whether plaintiff, having regard to the clause quoted, was or was not entitlail to practise as a dental surgeon in Singo- pore. Mr. Upcott remarked that the covenant put out of bounde most of the Middle and the Far East.
His Lordship-Half of Asia, in fact. Mr. Upcott cited various authorities and cases bearing upon the case, from his point of view, Mr. Carver replying with others which, he held, supported his; argumenti.
In the end judgment was given for Dr. Noble against Mr. Crago.
The Judge hold that although clause 75 was too wide and unreasonable and there- foro. invalid as regards some places, it was reasonable as regards Hongkong and Singapore. Judgment would be for defendant with costs.
| JAPANESE SHIPPING SUBSIDIES.

The Japanese Government has intro- duced into the House of Representatives a Bill providing for a renewal of subsidies. to the Nippon Yusen Kaisha, Toyo Kison Kaisha, Osaka Shosen Kaisha and a few other shipping companies. The term of subsidies now granted these companies expires by the end of this year.
