The recent revival of the colour question within the British Empire in on acute form has been shown by three separate incidents in three different quarters of the globe during the past. month. A shipload of Indian immigrants have claimed admission into Canada; another thinlond of Indians have claimed admission into New Zealand, and have prayed Magna Carta in aid when they were refused, and a deputation of South African natives has come to England to seek redress against legislation by the Union of South Africa, which they allege to be prejudicial to their interests.

The mere statement of these several cases obviously raises problems of extreme eventual difficulty, perhaps of toma

gravity. But before they are discussed from the point of view of Imperial policy it may be well to consider them briefly

The case of Indians at Vancouver has been dismissed by the Canadian Court, which has declared that Canada has the fall right to determine what persons shall and shall not enter the Dominion. This right, it may be pointed out, is of very old standing in Colonial law. The colony- of Massachusetts expelled in the seven- teenth century such persons as it thought undesirable citizens they were mostly who Cavaliers and ungodly persons, were unwelcome to the Puritan settlers- and its action was never challenged by the Imperial Government, which pro- fessed, although it seldom, in fact, exercised, general authority over the The overal Colonial Legislatures. colony of Georgia first prohibited, and subsequently admitted, the importation of negro slaves, and practically every colony from Massachussets and Pennsylvania to Jamaica and Trinidad passed legislation admitting or prohibit- ing the introduction of race-alions, On one occasion this right was pushed even further, and the little island of Barbados, the oldest and most English colony in the West Indies, prohibited the immigration of Irishmen.

The Imperial Government frequently intervened in the affairs of its colonies in the seventeenth and eighteenth centuries, modifying and cancelling their charters, and on one memorable occasion attempt ing to tax them but it never interfered in their right to control immigration. That right is indeed as inherent in a free colony as the right of a householder to admit whom he will to his own house.

The right to control immigration, which, in the old Colonial Empire, was tacit or assured, was specifically preserved to Canada under the British North America Act of 1867. It was not specifically preserved to Australia and New Zealand under the old State Con stitutions, nor to Natal under the Boveral original Natal Constitution. Australian Acts limiting Chinese immi- gration were therefore held up by the Imperial Government in the late nine- teenth century, but ultimately, under a compromise arranged by Mr. Chamber- lain, Asiatic immigration was in effect terminated.
