these circumstances application was made by the Holders

for permission to sur:

render their Lands

4. Considering

that

the Lots in question had

been purchased at the

outset of

the settlement at

a time of speculation, and

when their real value could

not be ascertained, Londay came to the conclusion that

there were

sufficient grounds

to authorize the resumption of these unimproved Grants on

condition that the Holders

should

pay up the arrears

of Rent which had become

due.

5. But the practice of

making

these resumptions can

not be indefinitely continued.

It appeared no more than

reasonable to allow them

when a

large part of the

Community suddenly discovered

that

they

had offered too

much for their Lands, but it

would be open to much

objection that Parties should have a Right of retaining the whole of their Property

as

long as they pleased, (yet

surrendering any part of it at any future
