Mr. Norrington confended that defen- dant's conduct all the way through the transactions showed that he was the principal, and his conduct led the plain tiffs to look to him also as the principal. The evidence which had been given went to show that this was so. The mess book was signed as caterer by those other other than the Chinese steward, and people were all Europeans. That was admitted. It was also obvious that defendant's conduct throughout was a combination of president and caterer, and if defendant carried on the caterer's book in the way he had done he made himself responsible. The defence said that the Chinese steward was paid 220 per month by each member of the mess United Serdang and that he acted in the capacity of an Mexican Eagle independent caterer, but that was not so: Rubber Plant.
