4- I cannot regard but regard this explanation as unsatisfactory, and insufficient. The charge against Marrant was that of Conspiracy against a public officer of the Govt was a very grave one. It was one which should not have been made except upon the clearest grounds. It was a charge which when so made, is less than justice to the party accused in whose name the prosecution was instituted requires to be pressed to a decision before a Judicial Tribunal.
