Sir Francis Piggott announced, before the decision was delivered, that he was prent to hear the judgment on behalf of Mr. Blade, who had left the Colony..

His Lordship in the course of a very lengthy judgment began by setting forth the case as follows:-

In March, 1912, the plaintiff was prrested and imprisoned under a warrant of a Police Magistrate of Hongkong on a charge of being a fugitive criminal who had been convicted of the crime of abduction in the Philippine Islands, and in the following month the plaintiff was discharged by the Full Court under a writ of habeas corpus

In November, 1912, the plaintiff to the "instigation of defendants was again arrested on the same charge of abduction under the warrant of another Police) Magistrate

The plaintiff claims as damages for this the equivalent in local currency of 2500 under section 6 of the Habers Corpus Act 1679 (31 Charles II., Chap. 2).

The defenciats admit the facts whilst donging liability and rely on the follow ing defences

(3.)-That the provisions of the Habeas Coryne Art are not in force in this Colomy.

(2.)-That the provisions do not apply to extradition proceedings.

As to the applicability of the abrus Corpus Act to extradition proceedings, this point. his Lordship observed, was taken by the Law Officers in Stallmann's ease; viz, that section 6 of the Act does hot apply to extradition proceedings, but it was apparently not dealt with or referred to in the judgments.. had in Kwok-a-Sing's case it was never raised it all when most distinguished Counsel appeared. There was abundant reason, therefore, tinder the circumstances, when the case is decideable upon other clear isses, for this Court not being called upon to give a definite ruling on the point of great importance. In Harsha's case, however decision of a Divisional Court in Carmdat was hold following a decision of a Victoria Cours that the Act does not apply to extradition pro- ceedings.
