The Man. Yuen firm. Berblinger & Co. was c case in which the plaintiffs claimed from the defendants the sum of $689.73, being loss of 18,023 yards of bleached stripss at 164 cents per yard.
Plaintiff did not appear, and were not represented. Mr. W. B. Hind (of Mr.
G. I. Hall Brutton's office) appeared for the defendants.
The statement of claim set out that by a contract bearing date 3rd April, 1012, defendante sold to the plaintiffs 10 cases of bleached stripes, 3,007, to arrive in Jaquary-February, 1913, in two lots. On or about 25th January, 1913, defendants duly notified plaintiffs of the arrival of the goods. On February 17th, 1915, plaintiffs applied to defendants for delivery of the goods, and pondered to the defendants the price therefor. Defendants failed and neglected to deliver to the plaintiffs the said goods. Plaintiffs had suffered damage to the extent of the amount claimed.
In the statement of defence defendnuts admitted entering into a contract for the sale of the goods mentioned with the Man
Yuen firm of Canton, but denied that plaintiffs were such firm. They further
