I was referred by Mr. Brutton to Lord Brougham's Act, 14 and 15 Viet, C 90. Part of that Act has been incorporated into our Evidence Ordinance No. 2 of 1989. In Section 23 of our Ordinance w find these words, and if the document sought to be proved is a judgment decree order or other judicial proceeding of any Court of Justice or any Consulate in any Foreign State or in any other British Colony or an affidavit, pleading or other legal document filed or deposited in any such Court or Consulate the authenticated copy to be admissible in Frideuce must purport either to be sealed with the seal of such Court or Consulate or in the event of such Court having no seal to he signet by the Judge, qr, if there are more Judges than one, by any one of the Judges of such Court, and such Judge shall atlach to his signature a statement in writing on the said copy that the Court wherent he Judge has no scal." Here it is laid down, that the copy itself must bear the seal.

am therefore of opinion that it is not absolutely necessary that such documents should be sealed provided that the requirements of Section 15 of the Act have been complied with. I therefore find as a fact that the documents herein have bee duly authenticated within the incuning of Section 15, Sub-section 3 of the Extradition Act 1870. I also find as a fact that the documents herein have been duly authenticated within the meaning of Section 15 of the Extradition Aet 1870, by the onth of the witness Thomas Carey Welch. My finding with respect to points 2 and 3 is therefore against the defentiant.
I shall now deal with the 4th point. The fourth point was that by Section 81 of the Habeas Corpus Act, the matter was res judicato.
