In the Court of Appeal, on June 20th, Lords Justice Vaughan Williams, Buckley and Kennedy had before them an appeal by the defendants against a judgment of Mr. Justice Baillinche in the case of Charles Wimble, Sons & Co, P. J. Rosen- berg & Sons, which raised, for the first time, the construction of an important section in the Sale of Goods Act, 1893. The plaintiffs (Mincing-lane brokers) by contract notes dated 27th June, 1912, hought for the defendants 200 bags of Arveenn ries at. 12s. 10fd, per cnt. La.b. Antwerp, to be shipped as required by the buyers within three racnths, custoni cary conditions, cash against bills of Inding of receipt in London. On the same day the plaintiffs sent a sold note in similar terms to Mr. de Winter at Antwerp, who was the seller of the rice, The defendants gave to the plaintiffs written instructions, which they received on 9th August, 1912, to ship the rice to Odessa, and to pay freight on their account not exceeding 12% 6d. per ton. The rice was shipped at Antwerp on the atr. Egyptian for Odessa, On the August, 1012. The vessel sailed the next day and stranded on the early morning of 20th August, -breaming a. total loss. Notice of the loss was posted at Lloyd's in the afternoon of the same day. The bills of lading, dated 25th August, and the invoice were not posted by Mr. de Winter to the plaintiffs till 28th August. | The bills of lading provided that freight was payable goods lost or Tot kist. Plaintiffs at once paid the foreign seller the amount of the invoice with other accounts. On 29th August they tendered the ductments to the defendants, who moediately tried to insure the goods. but found it was impossible.
