The defendant and the com- plainant were brothers, both being the sons of one Wu Piu, deceased. The com- plainant was the eldest surviving son of Wu Piu, and he believed the defendant Wa Pin was the other surviving son, had two other sons, one dying in infancy and the other was also dead. The latter had a son named Wu Suì, and he was to the grandson mentioned in this case.

There were only two part- ners in the Chung Wu, the deceased being one and the other being Wong Ming Cho, and he understood that each had a half reconstituted in share. The firm was 111, and Wu Piu, whose share was worth $18,000 odd, drew $14,000 cut and put $5,000 in the new firm. The Chung Wu was originally bought by two persons, but there were now four owners in all, two of them being Wu Piu (deceased) and In June, 1911, he Wong Ming Cho. would prove that Wa Piu arranged to buy out the other three and become sola owner, He did so, and bought the others out. for $7,000. After he had made this Arrangement with the other owners it would be proved that Wu Pin told Wong Ming Cho, in the presence of the defen- dant, that he intended to assign this pro- perty to his two sons and the nephew, that was to say, to the complainant, the defendant, and Wu Sul. Wu Piu at this time was a very old man indeed, and no doubt he wanted to do this to provide for his own people. He would prove that Wn Piu, in the presence of the defondant, informed a man named Wong Kwong of the same intention. On or about the 12th of June, 1911, Wu Pin sent for Wong Ming Cho. In the presence of the de- fendant, Wn Piu requested Wong Ming Cho to go to Mr. Otto Kong Sing's office and sign the assignment. At the same time Wu Piu told Wong Ming Cho that he had handed the purchase money to the defendant.

Commander Basil Taylor, R.N., the Harbour Master, sitting as Magistrate, yesterday beard brought by a junk owner against Captain Everetti, of the steamer On Lee for un- lawfully failing to observe the rule of the road in the harbour on November 16th. It appeared that the On Lee, when nearing her wharf, ran into a junk and capsized her. Captain Everett's defence was that the complainant's junk suddenly appeared under his bows, and a small paper lantern inside the junk was the only light showing. After hearing other
